I'm an experienced and licensed real estate broker in florida with more than 37 years of experience in many facets of residential real estate, mortgages, but especially in foreclosures.
I do know a lot more about the foreclosure topic than most real estate professionals. (ie. Realtors, Mortgage Brokers, Loan Officers, Investors and even attorneys, who don't specialize in foreclosures, many have called me to get up to date information.).

So there's this thing called an Automatic Stay, When it comes to Foreclosures, an Automatic Stay is created when anyone with an interest in the property, anyone that has been named as a Defendant within the foreclosure declares, or has filed for Bankruptcy.

A bankruptcy (automatic stay) stops everything and everyone. Processing and filing a bankruptcy is normally a very complicated process, but the part that won't tell you is that, you do not need to have all your paperwork submitted, in order and completed.

I had to learn

Years ago (back in 2008), when the real estate market crashed and no one could finance homes because of all the failing banks. I had to reinvent myself to help homeowners stop their foreclosure. The house was paid off when that happened. When I met them, the father had sadly just passed away. They had been living in the house for over 46 years. 4 Generations were currently living in the house. So, fast forward the son's business idea failed. The son couldn't pay the mortgage and of course, the bank quickly started foreclosing on the house. When I started working on their paperwork. I very soon find out that their home was already scheduled for foreclosure auction in 5 days. At that point, I immediately knew that I didn't have the time necessary to be able to get the bank and the court to stop, postpone or cancel the sale. I went back to the sister, had a family meeting and gave them the facts, and I gave them a check to reimburse their consulting fee because I knew that I couldn't deliver. They wouldn't take their money back, they were desperate. There were 4 family generations living in this home. Grandkids and Great Grandkids too. Their elderly mother didn't understand anything, she had beginnings of dimentia and was in denial about everthing. As you can imagine, its all overwhelming. They just didn't know what to do. They didn't know what options there were.
They literally begged me not to give them their money back, not to abandon them and to please, help them find an answer a solution. They had no where to go. They had no money to move. Definitely no monies to front up for. 1st month, last month and a month's worth of security deposit. I ask her to kneel down and over her knee to start going through this stack of papers and just sign. I told her, just sign every single page that required a signature. I told her, We'll let the clerk figure it out. Finally they let the public in the building at 8:00 AM. (today they don't open until 8:30 AM-auctions start at 9AM)
I finally got in with the 3rd batch of 10 people being let in. I get to the elevator, I rapid push the elevator button for it to get down, it felt like an eternity. The elevator finally opens. I go in. 2 other people get in with me. Finally, I get to the 7th floor, I practically run to the intake room for the bankruptcy department.
As I hand this huge folder of about 150 signed documents, my client just stands behind me and I start to sweat. I'm nervous. She thinks that I know what I'm doing, but I don’t. 20-30 seconds later, in come the other 2 people that went into the elevator with us. One of them goes to the only other available window. The 3rd guy, is in a business suit. He looks like an attorney. He stands behind us all. He looks at his watch. But we got their first, so he’s gotta wait his turn. Just then, the clerk walks up to the window, gets the folder through the window slot, quickly goes through it and says.
What's this?
I say, These are the bankruptcy papers. She glances at them quickly scans through them and says. No, these are all wrong
I'm thinking...
Oh my god, What have I done? This family is going to lose their home of 40+ years, they placed their hope and trust in me and I got it all wrong. The clerk takes out all the papers and starts going through them, she starts taking them out 1-by-1, saying - You don't need this one, You don't need this one. Almost all the papers that I spent 10 hours filling out, were wrong.
She then tells us... 
Your missing several other forms, and I cannot to tell you which one. My client and I look at each other and I say to the clerk. Could you please tell us which forms? clerk says - I'm sorry. I'm not allowed to help you with that. I can only take in the forms and verify if they are correct.
Meanwhile.....
The 3rd Guy, the guy that looked like an attorney. (He didn't know it, but he was God sent!!) He was in fact an attorney. He was there to also file a bankruptcy, to stop a foreclosure for one of his clients. But we were in his way. He can tell that we weren't going to go away. He needed the clerk that was in our window. Well he figured, the only way that we were going to get out of the way was if we got help with the right paperwork. So he interrupts us all.  
He says...
Let me see if I can help you, Let's me see what you have. I give him the folder, he puts it on top of a folding table that is up against a wall behind us, it had electric typewriter on it. He starts going through it. He pulls out the only two correct forms that I had, he turns around and tells the clerk. Hey, could you please give them form number XXX and form number XXX and a blank piece of paper? I only had 2 forms right. The other 146+ documents were wrong. He just spits the names of 2 forms that we needed, We were in shock, how he knew exactly what was needed.
The clerk handed us the two forms. The attorney tells us to quickly fill them out by hand. He then gives us the blank piece of paper and tells us to type a few addresses on the typewriter that's on top of the folding table. We're like... THAT'S IT? He tells us Yes, you can amend this later, but for now you can file your paperwork and get the Notice of Bankruptcy Case Filing that you need so that you can rush over to the auction room. We turn around, hand over the four forms in total, along with the typewritten piece of paper and give the clerk the cash for the bankruptcy filing fee. 
WAIT, there's more . .
The attorney stops us and says. You don't have to pay the whole filing fee today. He turns to the clerk and asks for another form. She gives us the form, we quickly fill it out with his help and wallah.
WE'RE DONE!
We turned it all in with half of the filing fee paid and we got to walk out of there with our golden ticket. The notice of bankruptcy case filing and with the attorney that helped us. We followed him, since we had to go to the same place. We walked to another building, went up another elevator and walked into a room, full of people. There must have been 100-120 people. They were all investors bidding on properties.

Thank God that it's different today.  

They're not located in the immigration building any longer. They got moved to another federal building. It use to be that you would just cross the street and stop the auction. Now the buildings are 3-4 blocks apart. And all the bidding is done online, which unfortunately makes the process faster which means, you have less time if you're doing this the day of the auction.
BIG TIP: 

Don't wait till the DAY of the Auction (unless you have to) The stress will age you 20 years.

Every homeowner that is scheduled to be auctioned off in the coming days, weeks is available to the public. It's public records if you know where to look. This is why you are getting so much advertisement mail from Realtors, Attorneys and even hand-written notes and letters from Investors passing themselves as buyers. The common fatal mistake, that many distressed homeowners make is that...
  • They hire a realtor to list the house, to short sale the house. They make the mistake of thinking that just because they list it and put it in the MLS, that the judge is going to stop the sale. NOPE!
  • ​Sometimes, they somehow get it right and get a court hearing scheduled (which you have to go if they're not an attorney) and present the judge a contract saying that they have it sold.
No! That's Not The Way It Works
In order to attempt to ask a judge to cancel a sale an auction, you need a specific amount of time (7-10 Days) to prepare the proper motion, prepare a notice of hearing, sign, scan, efile (if you can figure it out). Nowadays, they don't even allow you to hand deliver the courtesy copy to the judge's JA. Most everything is done electronically.
It's Like A Puzzle, a MAZE  And Not That Easy.
And you have to notice everyone one (that's legal talk for send a copy of everything to everyone in the service list, everyone involved in the court case)
When you file bankruptcy
  • you don't have to do any of this.
  • ​You don't have to "notice" anyone. 
  • ​You don't have to go in front of a Judge.
That procedure of scheduling a hearing, changes all the time. It's different for most judges. Eventually, if you do make it on time in front of a judge, usually the judge is going to ask you several questions:
  • How much is the offer for?
  • ​How much deposit was given by the buyer?
  • ​How much is the judgment for? 
The Judgment is the court ordered total owed, which includes all the principal balance plus all the backed up payments plus all the attorney fees plus all monies advance by the lender (ie. real estate taxes, forced placed insurance, and anything else that they had to front monies up for)
- Is the deposit held by an attorney? a title company?
- How Long has a mortgage payment not being paid?
Usually, when the judge sees that the numbers don't make sense-the judge doesn't consider it to be a legitimate sale. The judge also looks at how many times a defendant has asked for cancellations/extensions. The Judge looks if any bankruptcy were previously filed that already cancelled or postponed the sale a prior auction. We've experience that the Judge becomes indifferent and denies any further extensions.
When that happens, Your Screwed. Money/Effort/Time was passed and wasted.

They literally just check the court docket records, look up the names of the defendants, match the name of the certified copy of the bankruptcy paper, the Notice of Bankruptcy Case Filing. And once the name matches the name of any of the defendants in the court docket.

BAM!! The clerk in the Circuit Court -  Immediately, Instantly stops, cancels, Postpones the Foreclosure Auction.

The filing of a bankruptcy will definitely stop the foreclosure auction and everyone from proceeding with anything until the bankruptcy court addresses the matter, until you file the rest of the required paperwork or until the bankruptcy gets dismissed (closed out because you didn't qualify, you missed providing some paperwork, payments, etc.)
Right now I would focus on stopping the foreclosure auction first. The follow up of the rest of the paperwork, you can do after you file the bankruptcy and stop the foreclosure.

Here is where I might consider meeting with a knowledgeable bankruptcy attorney and have him/her give you the realistic options of whether you can qualify for a loan modification thru the bankruptcy court (vs. getting a loan modification directly with the lender)
There is a difference...
There's a difference between how typically an attorney initially files bankruptcy, and how I would file the initial paperwork of a bankruptcy. You might not understand strategic bankrupcty like I do. I'll get back to this below in further down with an interest in the property.

What Should Never Be An Option is

Losing your property, your home, in a foreclosure auction. This should never be an option. It will get much worse once the bank takes it back or a 3rd party/investor purchases it at the auction. The nightmare begins.
FOR STARTERS...
The mortgage lender (or the credit collection agency that they transfer their rights to), many times the final judgment (the court order) already has built into the language that allows the new title holder to take possession of the property after the auction (evict the occupants) ASAP and garnish (legally take money out of ) your wages, your bank accounts, your income tax return that you were expecting.
They can come after other assets that you might have too, possessions like boats, cars, motorcycles, anything that they think has value. They literally, come like a thief in the night, don't tell you and whoosh your hard earned monies get taken out of your pay check, your money disappears from your bank accounts, your income tax return check gets intercepted and given to them.
But right now, Let's focus on one thing - The urgency of stopping the foreclosure auction.  

What About The Tenant? 

We've seen tenants (and other people that are not the owners of the property) stop the sale (foreclosure auction) with a bankruptcy.

So this is how it works, I'm going to say it again. the moment you file bankruptcy once the Clerk of the circuit court is presented with a certified copy of the Notice of Bankruptcy Case Filing.

HOW?/WHY?
Because the foreclosure had their name as a possible Defendant. You see, before the bank's attorney files their initial foreclosure papers they research the title of the property. I see big banks and their attorneys at bullies. You might know this, but many times, these banks don't rightfully own your loan and don't have a right to be foreclosing on you. Any one of the people named as a defendant who files bankruptcy can stop everything having to do with the foreclosure.
(Check your foreclosure paperwork, at the end, there's a service list which the lender's attorney lists all defendants by name.). YES... Including the Tenant.

Strategic Bankruptcy

Generally, in most cases, an attorney is going to file a bankruptcy chapter 7 or chapter 13. The quick simple difference is with a chapter 7 you pretty much flick off say F-U- to everyone all your creditors, including your mortgage lenders. But then you have to surrender the property. Turn it in, voluntarily. Like a voluntary repo (repossession) of your car.
With a Chapter 13 you're intending to get into a payment plan with your mortgage lender and maybe your creditors.
This is complicated and I'm not here to get into all those details. If you want to get into a payment plan with your mortgage lender and possibly your creditors, you definitely need to see an attorney. One that specializes in Chapter 13, because they are complicated. You're essentially telling the bank and their attorneys that you intend to get into a payment plan. 
If it were me...
If I were the one facing the foreclosure auction, If it was coming right up. My goal, My Mission would be to stop the foreclosure auction, get time and look/research what my realistic options are. I would arrange to sit with at least 2 bankruptcy attorneys (just to compare). I would reach out to my lender and see what my "loan modification" options are.
I HATE BULLIES
I've seen it with my own eyes way to many times. It's kills me. It kills me to not be able to speak up and say something
(because I'm not an attorney and I can't give them any legal advice). So many times I've wanted to go out and tell them what I would do to stop the foreclosure auction. I understand that lenders have a right to their money and I understand that the property is the collateral.
I get it, I understand but c'mon, have some heart have some consideration unfortunately you're just a dollar amount
you're just a number.

I would be thinking, I'm sorry, but not sorry. If I can I'll leave on my terms. What's in my family's and my best interest. If I can't realistically qualify to stay, then on my terms, my timing.
I get a Short Sale Specialist, Make sure that they look after my best interests, see if they will help me (and know how to) possibly get me and my family some going away monies (cash for keys), for cooperating to move.  

I need to get time  to get organized.

Do we​ move in with my In-laws? (Do I really want to do that?)

OR where to move to?
If so, I will need to:

​Gather/save funds to move for 1st, Last & 1 month's security deposit, moving truck, find a home that I can afford, move near the area that my kid's school, transfer FPL, water & sewer, etc.

​Gotta make sure that I have the income needed to sustain the monthly payments from this point forward.
